RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-04811 XXXXXXXX COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. The overall rating and closeout date for his Enlisted Performance Report (EPR) for the period 1 June 2009 through 31 May 2010, be updated in the Personnel Data System (PDS) to reflect “5B-31 May 2010.” 2. His Fitness Assessment (FA), dated 26 February 2013, be removed from the Air Force Fitness Management System (AFFMS). APPLICANT CONTENDS THAT: Due to administrative reasons, the aforementioned EPR is not loaded in the PDS and should be updated to reflect an overall rating and close-out date of “5B-31 May 2010.” According to his AF Form 108, Physical Fitness Education and Intervention Processing, a medical evaluation revealed he had stage 3 kidney failure that precluded him from obtaining a passing score. In support of his request, the applicant provides copies of an AF Form 77, Letter of Evaluation and AF Form 108. His complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 13 May 1998, the applicant enlisted in the Regular Air Force. AF Form 108, Section III, Request for Medical Evaluation, dated 12 April 2013, indicates the applicant has stage 3 kidney disease. The AF Form 77 entered into the Automated Records Management System (ARMS) reflects, "Report for the period 1 Jun 2009 through 31 May 2010 is not available for administrative reasons. The PDS contains the following overall rating and close-out date pertaining to the missing report: “5B, 31 May 2010." ? AIR FORCE EVALUATION: AFPC/DPSID states that the corrective action requested by the applicant pertaining to his EPR has been resolved through pertinent administrative procedures. Therefore, it does not require referral to the Board. The re-accomplished AF Form 77 will be sent to the ARMS. The complete DPSID evaluation is at Exhibit C. AFPC/DPSIM recommends denial of the applicant’s request to remove the contested FA from the AFFMS. Under normal circumstances, when the Primary Care Manager (PCM) determines a medical condition exists that precludes a member from passing the FA, the PCM provides specific limitations. There is nothing in the evidence that reflects which components precluded the applicant from satisfactorily completing the FA. In accordance with AFI 36-2905, Air Force Fitness Program, "all members will complete an abdominal circumference assessment unless exempted by medical provider." Simply stated, without identifying specific limitations, there is insufficient evidence to indicate the FA should be invalidated. The complete DPSIM evaluation, with attachment, is at Exhibit D. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 22 September 2014, copies of the Air Force evaluations were forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit E). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. Therefore, aside from the administrative correction to his record, we find no basis to recommend granting the additional relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
